Asylum Weightlifting Club Ltd is committed to providing a safe, inclusive and well-managed sporting environment and to protecting the personal information provided to us. References on this page to “Asylum Weightlifting Club”, “the Club”, “we”, “our” or “us” mean Asylum Weightlifting Club Ltd. These Terms & Conditions explain the basis of Club membership, payments, cancellations and participation. They also explain how we collect, use and protect personal information. By completing a membership application and accepting these Terms & Conditions, the account holder confirms that they have read and accepted the terms below. Where membership is being purchased for a child or young person, the parent, guardian or account holder is entering into the membership arrangement on their behalf. Where an account holder provides personal information about a child or young person, the privacy sections of this notice also explain how we use and protect that member’s personal information.

Who We Are

Asylum Weightlifting Club is operated by Asylum Weightlifting Club Ltd, company number NI659549, a private company limited by guarantee without share capital.

The Club is registered as a Community Amateur Sports Club (CASC) with HMRC and operates as a community-focused, not-for-profit sports club providing coaching, education, training and related activities in weightlifting and associated strength sports.

Membership

By purchasing a paid membership, you enter into a rolling monthly membership with Asylum Weightlifting Club Ltd unless a particular membership level clearly states otherwise.

Membership provides access to the facilities, coaching, activities and other benefits included with the membership level selected. Access remains subject to Club opening arrangements, timetables, policies, eligibility requirements and reasonable operational changes.

There is no minimum contractual membership period for our standard rolling monthly memberships.

Adult gym access is subject to completion of a Club induction. New adult members are responsible for arranging their induction, which will normally take place during a scheduled adult training session. Once inducted, members may use the facilities during scheduled adult training sessions. Access outside supervised session times is not included automatically and is only permitted where the member has separately completed and signed the Club’s Keyholder Agreement, accepting responsibility for their conduct, safe use of the facility and compliance with applicable Club rules while training unsupervised.

Where membership is purchased for a child or young person, the parent, guardian or other account holder is responsible for:

  • the membership account;
  • the payment arrangement;
  • providing accurate information about the member;
  • keeping contact, medical and emergency information reasonably up to date; and
  • telling the Club about relevant information needed for the member’s safety or participation.

Membership details, prices and eligibility may vary between membership levels. The price and recurring payment frequency that apply to your membership will be shown before checkout.

If we propose a change to the recurring price of an existing membership, we will give appropriate advance notice and an opportunity to cancel before the new price applies.

Payments

Paid memberships are processed through GoCardless. When joining, you may be asked to make an initial bank payment while a Bacs Direct Debit is set up for future monthly membership payments.

Future payments are collected monthly by Direct Debit from the bank account authorised during signup. GoCardless will provide the required payment and Direct Debit notifications.

Direct Debit payments are protected by the Direct Debit Guarantee, including protection where a payment is collected in error and the right to cancel a Direct Debit through your bank or building society. More information is available at www.directdebit.co.uk.

Cancelling or refunding a Direct Debit does not remove any membership payment that is otherwise properly due to the Club.

Failed Payments

If a recurring membership payment fails, we will normally notify the account holder and provide an opportunity to resolve the outstanding payment. Membership access may be suspended while payment remains outstanding, and continued non-payment may result in the membership and recurring payment arrangement being cancelled.

Cancellation

Standard paid memberships are rolling monthly memberships and can be cancelled without a cancellation fee or minimum-term penalty.

Membership can be cancelled by:

  • logging into your membership account on our website and using the available cancellation option; or
  • completing our cancellation form, which provides the information we need to cancel the membership on your behalf.

Cancellation will normally stop future recurring payments while allowing membership access to continue until the end of the membership period already paid for.

You may also cancel a Direct Debit directly through your bank or building society. If you do so, please also contact us so that we can correctly close or update your Club membership. Cancelling the Direct Debit does not remove any membership payment already properly due.

Payments which have already entered the Direct Debit collection process may not always be capable of being stopped before collection. Where a payment has been collected in error, the protections of the Direct Debit Guarantee apply.

Membership cancellations will not normally be backdated unless required by law, a Club error has occurred, or we otherwise agree that this is appropriate.

Online Membership Cancellation Rights

Where membership is purchased through our website, you normally have 14 days from entering into the membership contract to cancel under consumer law.

Membership services may begin immediately at your request. If you begin using your membership during this period and later exercise your statutory right to cancel, we may charge a proportionate amount for membership services already provided.

To cancel during this period, contact club@asylumstrength.co.uk or otherwise clearly tell us that you wish to cancel. This does not affect your other statutory consumer rights.

Conduct

By joining the Club, members agree to follow the reasonable policies, procedures, safety requirements and codes of conduct of the Club, as amended from time to time.

These include:

Members are expected to behave respectfully towards coaches, volunteers, other members, visitors and competitors and to follow reasonable instructions relating to safety, safeguarding and the appropriate use of equipment.

Participation, Coaching and Safety

Weightlifting, strength training and related physical activities involve inherent physical risks. Members are expected to follow coaching instructions, safety procedures and equipment-use requirements.

Appropriate coaching may include physical demonstration or limited hands-on coaching or correction where reasonably necessary for safe and effective coaching. Any physical contact must be appropriate to the activity and carried out in line with the Club’s safeguarding requirements and appropriate coaching standards.

Safety requirements may include:

  • appropriate spotting;
  • use of collars or other safety equipment;
  • following platform and equipment rules;
  • following coach instructions during supervised sessions; and
  • stopping or changing an activity where there is a reasonable safety concern.

Where necessary in an emergency, suitably trained personnel may provide first aid, contact emergency services and take other reasonable steps to protect the member’s health and safety.

Photography and Video

Photography and video form part of normal Club activities and may be used to record and celebrate training, competitions, events and member achievements.

Photographs or video taken by or on behalf of the Club may be used for reasonable Club publicity and promotional purposes, including on our website, official social media accounts, printed materials and other Club publications.

The Club will use photographs and video responsibly and in accordance with our safeguarding, privacy and photography requirements.

  • Photography or filming organised on behalf of the Club will only be carried out by appropriately authorised persons.
  • Members and visitors must follow any restrictions on photography or filming within the facility.
  • Images will be selected and used respectfully and will not knowingly be used in a way that could reasonably be considered harmful, misleading or embarrassing.
  • Photography involving children and young people will be managed in accordance with our safeguarding requirements and the photography permissions recorded for that member.
  • Where more specific permission is appropriate, such as for a particular campaign, feature or publication, the Club may request this separately.

Adult members may object to the future promotional use of identifiable photographs or video of themselves by contacting club@asylumstrength.co.uk. We will stop future promotional use where appropriate and take reasonable steps to remove material under the Club’s control.

Where an image has already been printed, published or shared, it may not always be possible to retrieve every previous copy.

Emergency Contact Information

Where you provide details of an emergency contact, you confirm that the information is accurate and that you have informed the person that their details have been provided to the Club for emergency contact purposes.

We will use emergency contact information only where reasonably necessary for the member’s welfare, safety, safeguarding or another genuine emergency.

Privacy and Data Protection

Asylum Weightlifting Club Ltd is responsible for the personal information it collects and uses in connection with Club membership and this website.

We collect only information that we reasonably need to operate the Club, administer memberships, provide services, support members and meet our legal, safeguarding and organisational responsibilities.

Information We May Collect

Depending on your relationship with the Club, information we collect may include:

  • name and contact information;
  • account holder, parent or guardian details;
  • address and postcode;
  • date of birth;
  • sex registered at birth;
  • optional gender identity information where supplied;
  • membership type and membership history;
  • emergency contact information;
  • health, allergy, medical condition, disability, additional-needs or Special Educational Needs information where supplied;
  • attendance and participation records;
  • coaching, programming, testing or performance information;
  • competition, affiliation and sporting records where relevant;
  • payment and transaction records;
  • communications between you and the Club;
  • website account information;
  • IP address, browser information and security information where collected by the website; and
  • comments or information voluntarily submitted through the website.

We do not sell personal information or provide membership information to third parties for unrelated advertising or marketing.

Why We Use Personal Information

We may use personal information to:

  • create and manage membership accounts;
  • process and check membership payments;
  • provide coaching and sporting services;
  • manage training groups, competitions and events;
  • communicate important operational information such as opening hours, training times or competition arrangements;
  • manage safety, emergency and safeguarding requirements;
  • provide appropriate support for medical conditions, allergies, disabilities or additional needs disclosed to us;
  • maintain attendance, participation and appropriate sporting records;
  • record and promote Club activities, events and member achievements through appropriate photography and video;
  • affiliate competitors or members with relevant National Governing Bodies where required;
  • prevent fraud, misuse and security incidents;
  • meet accounting, regulatory, insurance and legal requirements; and
  • respond to enquiries, complaints or disputes.

Operational membership communications are different from optional promotional or marketing communications. We do not currently operate a general marketing newsletter. If optional marketing communications are introduced in future, appropriate choices and permissions will be provided separately where required.

Our Legal Reasons for Using Personal Information

Data protection law requires us to have a valid reason for using personal information.

Depending on what the information is being used for, this may include:

  • Contract: where we need the information to set up or manage your membership and provide the services you have requested.
  • Legal obligation: where we need to use information to meet a legal or regulatory requirement.
  • Legitimate interests: where we have a reasonable need to use information to run, administer, protect or promote the Club and its activities, provided this does not unfairly affect your rights.
  • Consent: where we specifically ask for your permission and consent is the appropriate basis for using the information.
  • Vital interests: where information needs to be used in a genuine emergency to protect someone’s life or physical safety.

Health, medical and some other sensitive information receives additional protection under data protection law. We will only use this type of information where the law allows us to and where we have a genuine reason for doing so.

We take particular care when using personal information relating to children and young people.

Sharing Information

We only share personal information where there is a genuine and appropriate reason to do so.

Depending on the circumstances, relevant information may be shared with:

  • authorised Club coaches, volunteers or administrators;
  • a member’s affiliated club, school or sporting organisation where this is part of the service or sporting relationship and sharing is appropriate;
  • National Governing Bodies where required for affiliation, competition or sporting administration;
  • appropriate healthcare or support professionals where the member has authorised this or another lawful reason applies;
  • emergency services or safeguarding authorities where required;
  • GoCardless and other payment-processing services used to administer membership payments;
  • hosting, email, security and other technical service providers used to operate and support our website and membership systems; and
  • professional advisers, insurers, regulators, law-enforcement bodies or courts where disclosure is reasonably required or legally necessary.

Where another organisation processes information on our behalf, we take reasonable steps to ensure appropriate data protection and security arrangements are in place.

If personal information needs to be transferred outside the United Kingdom, we will use appropriate safeguards where required by data protection law.

Payment Information

Membership payments are processed using GoCardless.

Bank payment authorisation is completed through GoCardless’s secure payment process. We keep the payment references and transaction information needed to administer membership, reconcile payments and manage the membership account.

We do not ask members to provide online banking passwords or similar banking login details to the Club.

Cookies

Our website may use cookies needed for login, account functionality, security and user preferences.

For example, temporary cookies may be used to check whether a browser accepts cookies, and login cookies may be used to keep a member signed into their account where requested.

Other cookies or tracking technologies will be managed through the website’s cookie settings and in line with applicable requirements.

Embedded Content From Other Websites

Pages on our website may include embedded content such as videos, images, maps or other external resources.

Using embedded content may be similar to visiting the external provider’s website directly. Those providers may collect information, use cookies or monitor interaction with their content in line with their own privacy policies.

How Long We Keep Information

We keep personal information only for as long as reasonably necessary for the reason it was collected and for any later legal, accounting, safeguarding, insurance or dispute-resolution requirements.

Different types of information may therefore be kept for different lengths of time.

Membership profile information can normally be updated by the account holder. Some historical membership, payment, financial or safeguarding records may need to be kept after membership ends where there is a legitimate or legal reason to do so.

Website comments and associated information may be retained where needed for website administration and moderation.

Your Data Protection Rights

Depending on the circumstances and the reason we are using your information, you may have rights including:

  • the right to obtain a copy of personal information we hold about you;
  • the right to have inaccurate information corrected;
  • the right to request deletion of information in certain circumstances;
  • the right to ask us to restrict how information is used in certain circumstances;
  • the right to object to certain uses of your information;
  • the right to receive or transfer certain information where data portability applies; and
  • the right to withdraw consent where we rely on consent to use your information.

These rights do not apply in every situation. We may sometimes need to keep or continue using information where there is a legal, safeguarding, financial, contractual or other lawful reason.

Spam and Website Security

Visitor comments, login attempts and other website activity may be checked using automated security or spam-detection services to help protect the website and its users.

Enquiries and Complaints

The Club’s directors oversee data protection, membership administration and compliance.

The Club should be the first point of contact for questions or complaints about membership, payments, privacy or these Terms & Conditions.

Where possible, please submit complaints in writing to club@asylumstrength.co.uk. We will acknowledge and investigate complaints in line with our complaints procedure and will normally aim to provide a substantive response within 15 working days.

If your complaint relates to the use of your personal information and you remain dissatisfied after contacting us, you can also raise a concern with the Information Commissioner’s Office: Information Commissioner’s Office.

Changes to These Terms

We may update these Terms & Conditions and privacy information where our services, membership arrangements, payment systems, policies or legal obligations change.

Where a change materially affects an existing paid membership, we will provide reasonable notice where appropriate.
